The Channel Store S.L. ("TCS," "we," or "us") is responsible for the processing of personal data handled under this privacy policy and, as such, must ensure that processing complies with applicable legislation.
This Privacy Policy explains the collection, use, and sharing of information from or about you in connection with your use of TCS Services. The term "TCS Services" refers to the services offered by TCS to content creators, distributors, platforms, and users, among others, as well as any other product, features, tools, materials, or other services TCS offers from time to time through various access points.
By viewing any Content or using TCS Services, you agree to the collection and use of information from or about you as explained in this Privacy Policy. If you do not agree to the collection and use of information from or about you in accordance with this Privacy Policy, you may not use TCS Services.

Below is a summary of how your personal data is processed. You will find more detailed information after this summary.
We need to use personal data to provide you with TCS Services. This means that you cannot object to the processing of all your personal data while continuing to demand that we provide TCS Services. However, you have the right to object to certain uses of your personal data, for example, if the relevant use is not essential for us to provide our TCS Services but is instead necessary, for example, to send you advertising via email. This right is explained in more detail in Section 6, "Your Privacy Rights."
As a data subject, you also have several rights that allow you to better understand and influence how TCS processes your personal data. These rights include the right to access personal data that TCS holds about you, the right to request correction of incorrect data, the right to request deletion of personal data, and the right to file a complaint with regulatory authorities if you have concerns about how TCS uses your personal data. In this document, the end user of a Client whose data is received by TCS as part of the Services is referred to as an "End User." You are an End User if, for example, a Client uses our Services and you watch the Client's channel or use the Client's streaming player on a Viewing Platform, resulting in TCS collecting data. "Viewing Platform" means any medium through which channels or video-on-demand (VOD) content can be viewed, such as a connected TV, smartphone, tablet, desktop computer, etc.
When an End User views or interacts with video content, video advertising, or real-time video players through a Client using the Services, TCS collects data about this interaction, such as (if the Client makes it available and to the extent that it is made available): IP address, device identifier or advertising identifier, user agent, application ID, date and time of interaction, viewing duration, country where the End User is located, device type, operating system, content and advertisements viewed (which may include program, channel, and genre, as well as audience group and demographic target group for the type of content), type of interaction with content and advertising, and other pseudonymous information made available by the End User's device or browser (collectively, "Service Data"). Service Data does not include, and the Services do not collect, use, or allow data that directly identifies a person, such as name, address, phone number, email address, or government identifier.
TCS collects Service Data through beacons embedded in the End User's video stream or via CDN (Content Delivery Network) logs.
Unless you inform us otherwise (by objecting) when subscribing to TCS Services or at any later time, we will process account identifiers, viewing history, and device information to create personal profiles. This means that, based on your use of TCS Services, we will assess your preferences and interests in different Content we offer. TCS uses this data to provide you with personalized information and news about content and special offers through digital marketing, to analyze how TCS Services can be improved, and to identify and segment target audiences with preferences similar to those of the User in order to extend digital marketing to these audiences, e.g., via Facebook and Google, or to identify User content preferences to personalize the content offered. This processing is partly carried out with the help of data collected through cookies. If you wish to object to the processing of your personal data for direct marketing purposes based on your profile, you can contact us via email and indicate your request.

2. Information we collect
TCS may collect the following information from or about you:
Information you provide to us. We collect information that you provide to us. For example, when you register to use TCS Services, either directly with us or through a vendor or partner, we may collect your first and last name, email address, date of birth, gender, phone number, postal code, and other information relevant to TCS. In addition, TCS may collect information that you provide to us when you respond to surveys, state your likes and dislikes, post reviews or ratings on Content, communicate with TCS through TCS Customer Services or other means, or participate in promotions that TCS may offer from time to time. The use of each piece of information we collect is detailed below in Section 3, "Use of Information We Collect."
Information we collect automatically. We collect information when you use TCS Services or view TCS advertising outside of TCS Services.
This information includes:

Details relating to your interactions with Customer Service, such as the date, time, and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number and call recordings;

We work with a number of business partners who help us provide TCS services, including, for example, our content developers, distributors, and telecommunications operators, among others. We may share information collected from or about you with these business partners.
Social Media Services
When you choose to share information with social media services about your activities on TCS Services, information about you and your activities will be shared with those social networks.
Service Providers
We may share information collected from or about you with companies that provide services to us and our business partners, such as analytics, data processing and management (e.g., to facilitate our advertising and marketing efforts), account management, hosting, technical and customer support, marketing (e.g., email, online communications, or direct mail), and other services.
Your Browsers and Devices
We may work with service providers who use the information collected from or about you to help us identify the browsers and devices you use for various purposes, including targeted advertising, analytics, attribution, and measurement. Advertisers and Advertising Service Providers
We may share information collected from or about you in encrypted, aggregated, or non-identifiable forms with advertisers and service providers that provide advertising-related services for us and our business partners to tailor advertisements, measure and improve advertising effectiveness, and enable other enhancements. This information includes your use of TCS Services, the websites you visited, the ads you viewed, and your other online activities.
Audience Measurement Providers
Our business partners, such as content developers, as well as our advertisers, seek to measure the performance of their creative content across many platforms, including TCS services. Consequently, TCS may allow the use of third-party measurement software that enables third parties (such as Nielsen) to include your viewership on TCS Services in audience measurement statistics, such as TV ratings.
Third Parties When Required by Law or Necessary to Protect Your or Our Rights
In some cases, we may disclose information from or about you without providing an option. For example, we may disclose your information in the following ways:

We promote TCS both on TCS Services and on other platforms and services. We also display advertisements from other companies on TCS Services, which often allow users to interact with the ads or click through to websites or other properties operated by other companies. This section provides additional information on the collection and use of information from you or related to such advertising.
When you view an advertisement, whether you click on it or interact with it, the advertiser, advertising technology companies, and service providers offering advertising services may collect certain information from or about you. The information practices of these third parties are governed by their own privacy policies and not by this Privacy Policy. Please note that TCS does not notify you when you choose to click on another website or property while using TCS Services. Use of Cookies and Similar Technology in Third-Party Advertising
What are cookies?
Cookies are small text files placed on your computer by websites you visit. They are widely used for the operation or more efficient functioning of websites, as well as for providing web services and functionalities to users. Your Rights
Right of Access and Rectification
You have the right to obtain information about which personal data TCS processes about you, the source of the data, the purposes for which the data has been used, and the identity of the parties to whom the data has been provided. TCS may charge a reasonable administrative fee for repetitive requests. If a request is manifestly unfounded or excessive, particularly due to its repetitive nature, TCS may also refuse to act on the request.
Likewise, you have the right to request, at any time, the correction of inaccurate or incomplete personal data.
Right to Erasure (“Right to be Forgotten”)
In certain circumstances, you may request the deletion of your personal data if, for example, you have unsubscribed from TCS Services, the personal data is no longer necessary for the purposes for which it was collected, there is no legal reason justifying its continued processing, the processing is unlawful, or the personal data must be deleted to comply with a legal obligation under applicable European Union law. Right to Object
You have the right to object to the processing of your personal data based on our legitimate interest, related to your particular situation. You may request the restriction of the processing of your personal data when the data may be incorrect, if you believe the processing is unlawful, if TCS bases its processing on a legitimate interest, or if you believe that TCS no longer needs the personal data for the purposes established in the “Use of Information We Collect” section of point 3.

If you have given your consent to TCS for the processing of personal data, you can always withdraw your consent for any future processing that is subject to that consent.
Right to Data Portability
You have the right to receive the personal data concerning you, which you have provided to us and that we process based on consent or to fulfill the contract established with you, in a structured, commonly used, and machine-readable format. You can also ask us to transfer this data directly to another data controller when technically feasible.
How to Exercise Your Rights?
You can exercise some of your rights, for example, the right to object to receiving marketing communications based on your usage, by logging into your TCS account. Once logged in, you can also correct some of your data.

What Should You Do If You Want to File a Complaint?
If you have a complaint regarding how we use your personal data, or if you want more information, please first contact us using the contact details provided above. However, you can also file a complaint about how we process your personal data with the relevant public supervisory authority, specifically with the authority in your country of residence, workplace, or where the alleged violation occurred. Without prejudice to your right to file a complaint, if you believe that your rights under this Privacy Policy have been violated due to the processing of your personal data in breach of applicable laws, you can also file a lawsuit before the competent courts, including the courts of the EU member state where you have your habitual residence.
7. Security and Account Access
We use a variety of physical, technical, and administrative measures to safeguard the information in our possession against loss, theft, and unauthorized use, disclosure, and modification. For example, we take steps to limit access to your sensitive information to TCS employees, agents, and contractors who have a legitimate business reason to access it. We also use measures such as encryption and hashing to help protect sensitive information during transmission.
Despite these efforts, please be aware that there is always a possibility of a data breach occurring in the transmission or storage of data. We want you to feel confident in our security when using the TCS Services, but we cannot guarantee the security of your information or information about you 100% of the time.
8. Minors
Children under the age of 18 are not permitted to register with TCS. TCS Services are not intended for use by children without the involvement and approval of a parent or guardian.
9. Data retention time
TCS will not retain or process your personal data longer than necessary to fulfill the processing purposes set out in this Privacy Policy or under any mandatory law, as detailed in “Use of Information We Collect” in Section 3.
Therefore, once the objective has been achieved in relation to a specific type of personal data, TCS will delete or anonymize the relevant personal data as soon as reasonably possible. Please note that we may retain your personal data to send you email newsletters and marketing materials for a period of time after you have terminated the TCS Services, to the extent permitted by applicable law. This period may vary depending on your country of residence. You may unsubscribe from newsletters or other marketing materials at any time by using the link at the end of the email from TCS containing the newsletter or other marketing materials.
10. Third-party access points, devices, and links
TCS Services may be provided through third-party websites, applications, and other access means operated by other companies (collectively, "Third-Party Access Points"). For example, you may access TCS Services through the websites of content distribution platforms. In addition, you may launch a third-party access point using various devices, such as mobile devices and TV devices. TCS Services may also contain links to third-party websites or applications. None of these third-party access points, devices, websites, or applications are operated by us, even if they contain our name or logo, and we are not responsible for the privacy practices of their operators. Accordingly, we encourage you to review their privacy policies.
11. Updates
TCS may modify this Personal Data Policy at any time. If TCS wishes to use personal data in a manner different from that stipulated in the Privacy Policy in effect at the time of data collection, it must notify data subjects of these modifications in a conspicuous manner (e.g., by posting the notice on the TCS website or sending it by email).
